Family hangs hope for boy on unproven therapy in India

New Delhi (CNN) — Cash Burnaman, a 6-year-old South Carolina boy, has traveled with his parents to India seeking treatment for a rare genetic condition that has left him developmentally disabled. You might think this was a hopeful mission until you learn that an overwhelming number of medical experts insist the treatment will have zero effect.

Cash is mute. He walks with the aid of braces. To battle his incurable condition, which is so rare it doesn’t have a name, Cash has had to take an artificial growth hormone for most of his life.

His divorced parents, Josh Burnaman and Stephanie Krolick, are so driven by their hope and desperation to help Cash they’ve journeyed to the other side of the globe and paid tens of thousands of dollars to have Cash undergo experimental injections of human embryonic stem cells.

The family is among a growing number of Americans seeking the treatment in India — some at a clinic in the heart of New Delhi called NuTech Mediworld run by Dr. Geeta Shroff, a retired obstetrician and self-taught embryonic stem cell practitioner.

Shroff first treated Cash — who presents symptoms similar to Down Syndrome — in 2010. “I am helping improve their quality of life,” Shroff told CNN.

After five weeks of treatment, Cash and his parents returned home to the U.S.

That’s when Cash began walking with the aid of braces for the first time.

His parents were thrilled. Before the treatments, Cash could only get around by hopping, his mother said. The results were enough to persuade Cash’s mother to go back to Shroff for more help.

“We saw evidence the first time that it’s worth trying again,” Krolick said. “In this particular case, with Cash’s other conditions, we don’t have many other options.”

For four or five weeks of treatment, Shroff says she has charged her 87 American patients an average of $25,000. It’s a big financial hit for Burnaman, a volunteer firefighter and property manager, and Krolick, who attends technical college in Greenville, South Carolina.

But the boy’s family and friends went into fundraising mode, creating a blog called ChangeForCash.com, and amassing about $50,000 over a year.

Are patients like Cash truly receiving treatments that improve their quality of life? Or is therapy giving patients false hope?

Doctors say all that work and hope and money Cash’s supporters have funneled into his experimental therapy likely will have no medical benefits.

There are several types of stem cells. Adult stem cells can be found in mature cells and some organs. For example, bone marrow cells are a type of adult stem cell that have been used in transplants for more than 40 years. But because adult stem cells are taken from parts of the body that already have a purpose, they may be limited as to what they can be turned into.

Embryonic stem cells are the controversial ones because they’re harvested from leftover IVF embryos, which are then destroyed in the process.

Embryonic stem cells come from 4-or 5-day-old fertilized eggs and have the ability to turn into any type of cell in the body.

Since human embryonic stem cells were first discovered in 1998, researchers have been trying to take these unique cells and coax them into becoming cells for every part of the body, which then could be used to repair damage or regenerate tissue.

For many years a virtual ban on funding this type of research slowed the field down.

Researchers have developed another source of stem cells: skin cells. Scientists learned to turn the clock back on skin cells so they’re like embryos — with stem cells that have the same “blank slate” properties like embryonic stem cells — but without the controversy. These cells are called “IPS” (induced pluripotent stem) cells — and are not yet being used in human experiments.

There are no approved embryonic stem cell treatments in the United States. However, the Food and Drug Administration has approved two experimental clinical trials in humans using treatments made from human embryonic stem cells. One of these — to repair spinal cord injuries — was stopped due to the high cost of this type of research; the other trial — to restore vision in people with macular degeneration — is still underway.

There is hope that embryonic stem cells might someday lead to treatments for Parkinson’s disease, diabetes, traumatic spinal cord injury, Duchenne muscular dystrophy and other conditions, according to the National Institutes of Health. Someday.

Nevertheless, Shroff isn’t waiting for further research. She’s injecting patients with embryonic stem cells now.

“There is zero evidence for what she is doing being effective,” said Rutgers University’s Dr. Wise Young, a leading U.S. neuroscientist.

“It’s concerning no matter how you look at it,” said CNN Chief Medical Correspondent Dr. Sanjay Gupta. “Frankly it’s the complete wrong way of going about this sort of science.”

Inside her clinic, surrounded by patients, Shroff disagreed.

“Success,” she said, “is defined differently by various groups of people within that therapy mode. So as of right now, almost everyone — greater than 90% — have had success.”

But Cash’s family has its doubters, too. The boy’s father said he still isn’t totally convinced the treatment works.

“If we had taken away the stem cells and hadn’t done it, is this where he would be naturally?” Burnaman said. “And that’s where I keep coming back to is — I’m not sure.”

“It’s risky medical therapy,” acknowledged Krolick, who feared it would worsen Cash’s condition. “But I knew that we were going to have to do it. We did pick this clinic for a reason. I mean, we did look around, and we decided this is the place where we felt safe. She had a good track record.”

An energetic doctor who trained in India, Shroff says she acquired embryonic stem cells with the patient’s permission after she performed an in-vitro fertilization procedure on a woman more than a decade ago.

She would not allow CNN access to the facility where she says the embryonic cells are kept and harvested.

Nurses and assistants at NuTech Mediworld routinely inject patients with embryonic stem cells daily simply by sticking the needle into a patient’s back.

The routine at the clinic starkly contrasts with procedures CNN observed at a sanctioned embryonic stem cell trial at Atlanta’s Emory University, where technicians and surgeons took hours to conduct a safe injection.

NuTech Mediworld’s treatment also includes physical therapy. The patient and a guest receive room and board. The rooms are cramped with bathroom facilities available down a long hallway.

Shroff has treated patients suffering from amyotrophic lateral sclerosis or ALS, more commonly known as Lou Gehrig’s disease. Others had spinal cord injuries, cerebral palsy, genetic and muscular skeletal disorders.

Pure embryonic stem cells are not meant to be put directly into the body, since they have to the potential to turn into any cell. That’s why credible researchers first chemically “coax” these stem cells into heading down the path of what they should turn into — for example nerve cells or heart cells — before injecting them into very specific parts of the body to achieve the desired results.

The doctor offered examples of her successes including a man from Baghdad who she said was a paraplegic because of multiple gunshot wounds and an Indian toddler who she said has a genetic disorder similar to Cash’s.

Kohl Guffey, an 18-year-old from Illinois who was paralyzed three years ago in a motocross accident, cites himself as another example of success at the clinic.

“Before I came here, I didn’t have any movement in my left hand between my fingers,” said Guffey. “Now I can retract them really good.”

Shroff conceded that when she attempted to present her findings to an internationally sanctioned stem cell conference, her medical abstract paperwork was rejected. But she continues to defend her work. “I believe that my patients are getting better,” she said. “I have proved it time and time and time again.”

She was present at a recent meeting of the Indian Council of Medical Research where prominent Indian physicians criticized embryonic stem cell clinics that have appeared in New Delhi and elsewhere throughout the sprawling country.

A leading Indian neurosurgeon, Dr. P.N. Tandon, agreed there was zero medical evidence of the effectiveness of embryonic stem cell therapy like that provided at NuTech Mediworld. There is no stem cell treatment proven in India that will make patients like these better, Tandon said, and none “proven anywhere in the world.”

Patients also have traveled for similar therapy in Central America, Mexico and China, although that country has recently clamped down on stem cell clinics.

For Young, the money charged for the therapy stands out as an ethical issue. “It’s all about $25,000,” he said. The cost of the treatment is “calculated to take a family to the brink of what they can afford, and they take everything.”

“Who doesn’t want to get rich?” Shroff asked. “Who doesn’t work for money? But you also have to work from the heart. You also have to see what you’re doing. Is it ethically right? And I believe I am doing everything right.”

Who was Bob Hill?

Born October 15, 1831, in Fernandina, Florida, Robert “Bob” Madison Hill was the first child born to Florida pioneers Elizabeth Munden and Chesley D. Hill.

According to Hill family records, in 1835, the Hills’ Fernandina home was attacked by raiding American Indians, forcing the family to flee to Fort Micanopy in Alachua County, where they remained for nearly 10 years.

It was here where the young Robert “Bob” Madison Hill spent his early childhood and likely received his formal education.

But, after living in Marion County for seven years, in 1850, the family moved to Polk County for a brief period before finding their way to Hernando County—this was the family’s last move.

Shortly after arriving in Hernando, Indian hostilities prompted Florida’s Third Seminole Indian War.

Following in his father’s footsteps, 25-year-old Robert “Bob” Madison Hill answered the call for arms and enlisted for a six-month stint with Lt. Richard B. Turner’s Detachment of Florida Foot Volunteers.

Following his brief service he returned to Brooksville, where he engaged in farming and working in the local elections as an inspector for the Nov. 4, 1856, election.

With the onset of the Civil War in 1861, Bob Hill, his father, and three brothers enlisted with the Confederacy, all three serving with Company C., 9^th Florida Infantry.

This military service led the Hill men to such battles as that of Olustee, Florida, where Robert’s brother was killed on February 20, 1864. Later service took them to major battles with Gen. Robert E. Lee in Virginia.

Life After the War.

From the Civil War battlefields, the Hill men returned to life in Hernando County, where the young Robert Hill struck out on his own.

According to Hill family research, leaving the family home, Robert made his way to the west coast where he settled at today’s Pasco-Hernando County line.

Here, on the coast, Hill not only began preparations to homestead 160-acres through the federal government, but he also purchased, from the state, the 40 acres surrounding what we now know as Bob Hill Springs.

By 1885, agriculture schedules show Hill had five acres of Indian corn, 4-acres of sweet potatoes, 40 pigs and at least 45 chickens and other poultry.

However, on December 14, 1886, before completing the full homestead requirements, Robert “Bob” Madison Hill died.

In the burial traditions of the time, Bob Hill was laid to rest on the land that he had so fervently toiled over, although it was not yet owned by the family.

Bob Hill’s Burial Controversy

Since Hill was unable to complete his homestead application due to his untimely death, according to state land records, in December 1926, the land containing his burial plot was purchased by Ralph W. Cook—the first owner since Hill’s death.

From there, the property began to change hands until it was eventually sub-divided for development.

According to Pasco County land records, in 1953, the tract containing the Bob Hill burial became part of a Gulf Coast Highway Estates subdivision created by M.L. Baynard.

However, Baynard sought to preserve the pioneer’s grave through deed restrictions on the property, which read:

“Lot 15, Block B is forever to its present occupant, Pioneer Bob Hill.”

Fast forward to 1983, and controversy arose when 51-year-old Walter Hill, Bob Hill’s great-grandson, discovered then-owner Garry Yaist had bulldozed Bob Hill’s gravesite.

According to The West Pasco Tribune, Walter Hill remembered visiting the gravesite when he was just a boy and was horrified when he discovered Yaist’s activities on the property.

“I was shocked to see the small tombstone leaning against a fence and a concrete slab that had covered the grave laying in a pile of what appeared to be trash,” Hill said.

Yaist, who had lived on the property for 13 years, said he didn’t think anyone cared about the grave site. “No one showed any interest and all I did was cut the stumps out ‘cuz I wanted to park my trucks there.”

Yaist reportedly agreed to pay to move the pioneer’s remains but revoked the offer when he learned the Hill family contacted the Pasco Sheriff’s Department to halt work on the property.

Sheriff’s deputies ordered Yaist to cease activities until the rightful owners and deed restrictions could be determined, and a detective was assigned to the case.

Meanwhile, according to The West Pasco Tribune, Yaist said he would continue to park vehicles on the property, except for the 6-by-3-foot gravesite. He added, after a thorough search of the property he believed there were no other graves.

However, the Hill family said that according to oral history handed down from past generations, possibly six or eight other family members were buried on the property.

In March 1984, the St. Petersburg Times reported Walter Hill and 30 other members of the Hill family filed suit against Yaist to force him to stop “desecrating” the grave and allow them to restore it.

Nine months later, in December 1984, the Sixth Judicial Circuit Court of Florida finally issued a final judgment in the matter.

After 98 years, the remains of pioneer Bob Hill were disinterred from the property and moved to the Geiger Cemetery near Zephyrhills, where Hill’s wife and other family are buried.

Today, Garry Yaist still lives on the property where pioneer Bob Hill was buried.

Bob Hill’s former 200-acre homestead is now divided by the soon to be eight-lane U.S Highway 19.

Judge halts casino construction

A judicial ruling has stopped construction of an Indian casino in Broken Arrow – at least for now.

U.S. Chief District Judge Gregory Frizzell on Friday granted a temporary injunction against the Kialegee Tribal Town and its casino developers, saying the casino would violate the state gaming compact and the Indian Gaming Regulatory Act because the Kialegees do not have “Indian lands.”

“When the casino project was launched, there was no exercise of Kialegee Tribal Town authority and governmental control,” Frizzell said. “After it started, they fenced the property, flew a flag on a residential garage and established a satellite office in that house.”

That was not sufficient to show that the Kialegee Tribal Town had established its “exercise of governmental power” over the land, the judge said.

The property, which is at the southwest corner of Florence Street (111th Street) and Olive Avenue (129th East Avenue), is a Muscogee (Creek) Indian allotment owned by Marcella Giles and her sister Wynema Capps.

“The land is not held in trust for the Kialegee Tribal Town, nor is it land held by members of the Kialegee Tribal Town,” he said.

Frizzell rejected the argument that the Kialegee Tribal Town and the Muscogee (Creek) Nation have shared jurisdiction because the property falls within the former reservation lands of the Creek Confederacy, granted in an 1833 treaty. The confederacy included all of the Creek tribal towns, including the Kialegee Tribal Town.

Frizzell said he will issue a written order after the state submits its proposed findings within the next 11 days.

“This matter was about enforcing the state’s compact,” Attorney General Scott Pruitt said following the decision. “The court issued (an order), in no uncertain terms, that construction must stop on the land in question. That’s very encouraging to the state. That means that the community and the state’s interests have been protected.”

Pruitt said Frizzell was methodical in arriving at his ruling.

“I was very pleased with the thoroughness of the order, the finding of the order and the fact that construction has been stopped on the land in question,” he said.

“The precedent that’s set is that the compact matters. It will enforce the compact. We stopped what we consider illegal gaming and what the court now considers illegal gaming.”

Attorneys for the casino developers said they will appeal the ruling to the 10th U.S. Circuit Court of Appeals in Denver.

“I suspect in Indian Country there is going to be a lot of anger,” said Defense Attorney Dennis Whittlesey. “It’s a very strong order.”

Whittlesey said the only way the developers can continue construction at the site would be to go back to the judge seeking permission to operate a nongaming business.

“I suspect you can look for that to come,” he said. “That’s one of the things that makes the injunction of construction really surprising in that there is no violation of law to construct a building on Indian land. I think we made that argument in the court,” he said.

“Enjoining construction was unusual, certainly under the Indian Gaming Regulatory Act and the compact, because they regulate gaming. They don’t regulate construction.”

Whittlesey said the issues of jurisdiction and governmental control would not apply to nongaming uses.

Whittlesey said he thought the issue could be solved at the 10th Circuit.

“I don’t think this is a Supreme Court case,” he said. “You’d have to find a constitutional issue.”

Vicki Sousa, attorney for the Kialegee Tribal Town, phoned the tribe’s town king, Tiger Hobia, outside the courthouse to tell him the ruling, which for the Kialegees was upsetting news.

“What this says is, ‘You’re inferior. Even though you’re Creek, you have no rights. You mean nothing. It’s your bigger, more powerful sister,’” Sousa said.

The court ruling could harm the relationship between the Kialegees and the Creek Nation, she said.

“We were negotiating for services that the Muscogee (Creek) Nation could provide the casino,” she said.

Luis Figueredo, one of the principals of casino developer Golden Canyon Partners LLC, testified Thursday that “the two chiefs,” Hobia and Creek Nation Chief George Tiger, had been in talks for the Creek Nation to provide its Light Horse Police services at the casino.
